Overview

This page sets out the terms that apply when you use the website of AmmoCat Construction LLC or engage the company for tracked earthworks. The company works from 102 N Hillside Dr, Mona - 84645-3339, United States (US) and can be reached at estimates@ammocatbuild.autos or on +12724625601.

The terms are arranged so that a client can follow the life of a project from the first enquiry through to the final invoice and a possible warranty visit. Each heading below covers one part of that journey. The page is written in plain English and avoids hidden conditions.

2. Acceptance of These Terms

These Terms of Service govern the use of the website hosted at www.ammocatbuild.autos and the relationship between the visitor or client and AmmoCat Construction LLC, a tracked earthworks contractor operating from 102 N Hillside Dr, Mona - 84645-3339, United States (US).

By browsing the website, sending a message through the contact form, calling the published number or accepting an estimate, you agree to these terms. If you do not agree, please do not use the website or the services described on it.

These terms work together with any signed contract, purchase order or written estimate for a specific project. Where a signed project document conflicts with these terms, the signed document controls for that project.

3. Who We Are and What We Do

AmmoCat Construction LLC performs site trenching runs, grading and leveling, track road building, cut and fill balancing, trench backfill programs and site prep estimates using tracked machines.

The company works from its Mona yard and mobilizes to sites within a reasonable travel distance. The company is not a general contractor for building construction and does not design structures.

The services described on this website are subject to availability, site conditions and the capacity of the crew at the time a request is made. A page on the website is not an offer to perform work at a fixed price.

4. Website Use and Permitted Conduct

You may read the website, print pages for your own reference and send the contact details to others who are involved in a project.

You may not copy the website in bulk, use automated tools to scrape its content, attempt to gain access to restricted areas, introduce malicious code or interfere with the normal operation of the site.

You may not use the website to send unlawful, misleading or abusive messages, or to impersonate another person or organization.

Reasonable use also includes quoting a short passage from this website in a project note or a funding application, provided that the source is identified and the meaning is not changed.

The company reserves the right to block a network or address that generates excessive requests, attempts to upload files or repeatedly submits empty contact forms.

5. Estimates and Quotes

Every estimate is based on the information available at the time it is prepared, including the site walk, the drawings supplied, the depth and distance measured on site and the access conditions observed.

An estimate is valid for thirty days unless the document states otherwise. Prices may change when ground conditions, haul distances, utility conflicts or the scope of work differ from the assumptions recorded in the estimate.

An estimate becomes a binding agreement only when AmmoCat Construction LLC accepts the work in writing and any required deposit or confirmation is received.

6. Scheduling and Site Access

The client is responsible for providing safe and clear access to the work area, including gates wide enough for the tracked machines, a stable entry and an area where spoil can be placed legally.

The client must arrange any permits, utility locates, easement approvals and access agreements that the work requires, unless the estimate states that the company will arrange them.

Weather, ground conditions and utility conflicts can change a schedule. The company will notify the client as soon as a change is known and will agree a revised date where possible.

A site walk is not a confirmation of a start date. The start date is confirmed in writing once the estimate is accepted and the calendar allows.

Where a schedule slip is caused by the client, for example a gate that remains locked or a locate that has not been requested, the company may charge for the lost machine time at its current rates.

7. Client Responsibilities

The client must disclose known underground services, private lines, septic components, wells, irrigation and any other buried item that could be damaged by excavation.

The client must mark or describe the boundaries of the property and must have the legal right to authorize the work on the site.

The client must keep unauthorized people, pets and vehicles out of the work area while machines are operating, and must follow any safety direction given by the crew.

8. Underground Utilities and Unknown Conditions

Public utility locates are requested before excavation where the service applies. A locate marks only the lines that the utility owns up to the meter or the property line. Private lines beyond that point remain the responsibility of the client to identify.

If an unmarked line is struck, the crew will stop work, make the area safe and notify the client and the utility owner. Repair costs are handled according to the responsibility for marking and disclosure.

Rock, buried debris, abandoned tanks, high groundwater and contaminated soil are examples of conditions that cannot always be seen before work starts. When such a condition is found the company will discuss options and any change to price or schedule with the client before continuing.

9. Changes to the Work

A change to the scope, depth, route or schedule is recorded in writing, usually by email or by a signed change note, before the additional work is performed.

Where a change is urgent and cannot be documented first, the company will confirm the change in writing as soon as practical after the work is done.

Additional work that is not covered by the original estimate is priced using the rates in that estimate where possible, or at the current rates of the company.

10. Payment Terms

Unless the estimate states otherwise, invoices are payable within fifteen days of the invoice date. A deposit may be required before mobilization on larger projects.

Payment can be made by the method shown on the invoice. The company will provide a receipt for every payment.

An overdue balance may attract a late charge where permitted by law and where the charge was disclosed in the estimate or the invoice.

Where the project is staged across several visits, the company may issue progress invoices that reflect the work completed at each visit.

A question about an invoice should be raised within seven days of receipt so that the record can be checked while the crew still remembers the site.

11. Suspension and Termination

The company may suspend work where the site is unsafe, where access is blocked, where a required locate or permit is missing or where an undisputed invoice remains unpaid after a reminder.

Either party may end a project for a material breach that is not remedied within a reasonable period after written notice.

If a project ends early, the client pays for work completed, material ordered for the project and reasonable demobilization costs. The company will return unused material deposits where appropriate.

12. Workmanship and Warranty

The company performs its work in a workmanlike manner and in line with the specification agreed for the project.

The company will return to correct a defect in its own work that is reported within twelve months of completion and that is caused by the workmanship of the company rather than by later activity, settlement caused by others, or a change in site conditions.

A warranty request should be sent to estimates@ammocatbuild.autos with a description and photographs of the issue so that a site visit can be arranged.

Normal settlement of fill material, minor surface dust and the gradual growth of vegetation are not defects. They are expected outcomes of earthworks that move natural ground.

Damage caused by vehicles, stockpiling by others, later trenching or landscaping by a different contractor is outside the warranty.

13. Limitation of Liability

To the extent permitted by law, the total liability of AmmoCat Construction LLC for a project is limited to the amount paid for the work that gave rise to the claim.

The company is not liable for indirect or consequential loss, including loss of profit, loss of use or delayed opening, except where the law does not allow that exclusion.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or for any other liability that cannot lawfully be excluded.

The company keeps records of depths, grades and lift counts so that any question about the finished work can be answered from the project file.

A client who believes a loss has occurred should notify the company promptly so that the site can be inspected before the evidence changes.

14. Site Safety and Insurance

The work area is a live machine zone. Only authorized people may enter it, and only with the agreement of the operator.

The company maintains insurance appropriate to its earthworks operation and can provide a certificate on request before work begins.

The client is responsible for the safety of the site outside the work area and for any structures, services or landscaping that are not part of the agreed scope.

15. Intellectual Property

The text, layout, illustrations and code of this website belong to AmmoCat Construction LLC or are used with permission. They may not be reproduced for commercial purposes without written consent.

Project drawings, survey files and other documents supplied by the client remain the property of the client. The company uses them only for the project.

The company may photograph completed work for its records and, with the written agreement of the client, for its portfolio. Site photographs are never published with client contact details.

16. Privacy

Personal information is handled as described in the Privacy Policy published at /privacy. That policy explains what is collected, why it is collected and how a person can exercise privacy rights.

By using the website or engaging the company you confirm that the information you provide is accurate and that you are entitled to share it.

Questions about privacy can be sent to estimates@ammocatbuild.autos or raised by phone at +12724625601.

17. Third Party Services and Links

The website may refer to utility locate portals, mapping services, permit offices and suppliers. Those services are operated by other organizations and are governed by their own terms.

The company is not responsible for the content, availability or practices of a third party service. A reference on this website is provided for convenience and is not an endorsement.

Where a third party service is used to deliver part of a project, for example a haulage subcontractor, the company remains the point of contact for the client.

18. Electronic Communications

By providing an email address you agree that the company may send project messages, estimates, invoices and notices to that address.

Email is convenient but not perfectly secure. The company will not ask for payment card details by email. A message that appears to request sensitive information should be verified by calling +12724625601.

A message sent through the contact form is treated as received when it arrives in the company mailbox, not when the send button is pressed.

19. Force Majeure

The company is not liable for a delay caused by an event outside its reasonable control, including severe weather, flooding, wildfire smoke, road closures, utility strikes by others, supplier failure or a public health order.

The company will notify the client of the event and will resume work as soon as it is safe and practical to do so.

If the event continues for an extended period, either party may agree to reschedule or end the affected part of the project without penalty.

The company keeps a weather log for the Mona yard and can share the relevant entries where a delay is caused by conditions that also stopped other crews in the area.

A rescheduled date offered after a force majeure event keeps the original pricing where the scope and the season remain the same.

20. Dispute Resolution

The parties will first try to resolve a dispute by discussion and a site meeting. Most issues about grade, access or scope are resolved at that stage.

If discussion does not resolve the matter, the parties agree to consider mediation before starting legal proceedings.

These terms are governed by the law of the state in which the company operates, without regard to conflict of law rules. A court in that state has jurisdiction over a dispute that is not resolved by discussion or mediation.

21. Severability and Waiver

If any part of these terms is found to be invalid or unenforceable, the remaining parts continue in full force. The invalid part is replaced by an enforceable provision that comes closest to the original intent.

A failure by the company to enforce a term on one occasion is not a waiver of that term on a later occasion.

A waiver is effective only when it is given in writing and signed by an authorized representative of the company.

22. Entire Agreement

These terms, together with the accepted estimate and any signed project document, form the entire agreement between the client and AmmoCat Construction LLC for the project.

Earlier conversations, drafts and preliminary figures do not form part of the agreement unless they are incorporated into the accepted estimate or a written change note.

If a provision of these terms is unclear, the parties will interpret it in a way that gives effect to the commercial purpose of the project rather than against either party.

Where a client uses a purchase order, the terms of that purchase order apply only to the extent that they have been reviewed and accepted in writing by the company.

The headings used in this page are for convenience and do not change the meaning of the clauses beneath them.

23. Changes to These Terms

The company may update these terms to reflect a change in the law, a new service or a change in operating practice.

The effective date at the top of the page is updated when a substantive change is made. A client with an active project is governed by the terms in force when the project estimate was accepted, unless the client agrees to the updated version.

Continued use of the website after a change is published means that the updated terms apply to future visits and future enquiries.

A copy of the version that applied to a project is kept with the project file so that the terms can be checked later without relying on memory.

If a change would materially reduce the rights of a client with an active project, the company will contact that client directly rather than relying on a website notice.

24. Contact Information

Questions about these terms can be sent to estimates@ammocatbuild.autos or raised by telephone at +12724625601 during business hours.

Written correspondence can be sent to AmmoCat Construction LLC, 102 N Hillside Dr, Mona - 84645-3339, United States (US).

The company aims to answer a written question about these terms within two working days.

Acknowledgement

By using this website or by accepting an estimate, you confirm that you have read these terms, that you understand them and that you agree to be bound by them. If you do not agree, please contact the company before work begins so that the point can be discussed.
